The Push for a Senate Floor Vote

Republican senators Tim Scott and Cynthia Lummis are pressing hard for a full Senate floor vote on the Digital Asset Market Clarity Act before the August recess, a window that closes around August 10. Lummis has warned that failure in the current window could defer meaningful market structure legislation until 2030.

The bill has already cleared the House, passing 294 to 134, and cleared the Senate Banking Committee 15 to 9 on May 14, with all 13 Republicans joined by Democrats Ruben Gallego and Angela Alsobrooks. Both Democrats attached caveats that their committee votes do not commit them to support final passage. Senate Banking Committee Chairman Tim Scott struck a confident tone, saying the CLARITY Act will pass before the August recess.

The 60-Vote Problem and What Is at Stake

The bill's core aim is to bring regulatory clarity to the digital asset industry. The Digital Asset Market Clarity Act draws a line between the SEC's jurisdiction over securities and the CFTC's oversight of commodities as those categories apply to digital assets, and also tackles token classification, decentralized finance oversight, and consumer protections.

The math, however, is tight. The bill must clear cloture to escape a filibuster, which means 60 votes. Republicans hold roughly 53 seats, leaving the framework about seven votes short even with full Republican unity. Three major friction points are complicating the Senate's path forward: ethics rules, illicit finance provisions, and turf negotiations with other Senate committees that want a say in how digital assets are governed.

Nine Democrats, including Senator Elizabeth Warren, voted against the bill at committee stage; Warren has described the bill as a threat that will "blow up the economy" and filed 44 amendments during markup, most of which were rejected. Several other Democrats have signaled they will not support the legislation unless law enforcement concerns have been adequately addressed.

Despite the obstacles, industry pressure is mounting. More than 200 companies and groups have urged Senate leaders to schedule the bill for a floor vote, with signatories including the Blockchain Association, Stand With Crypto, the Crypto Council for Innovation, and the Digital Chamber.

Galaxy Research cut its passage estimate to 60%, citing the Senate calendar as a main risk and warning that July action was needed before the August recess. Brian Gardner, chief Washington policy strategist at Stifel, wrote that "if the Senate fails to pass the bill before the August recess, the bill's prospects would deteriorate materially." In a late June development, Senate Majority Leader John Thune secured unanimous consent to adjourn until July 13, tightening the available floor time still further.
