Senator Cynthia Lummis (@SenLummis) is pressing hard for Congress to pass the Digital Asset Market Clarity Act, widely known as the CLARITY Act, before lawmakers break for the August recess. In her view, the current legislative session represents the last realistic window to cement a comprehensive federal framework for digital assets before 2030.

A Shrinking Window

The urgency is real. Lummis, who chairs the Senate Banking Subcommittee on Digital Assets, has been one of the most vocal crypto policy advocates in Congress. She announced in December that she would not seek reelection in 2026, adding a personal dimension to her push to see the bill through.

According to Crypto Briefing, Lummis is targeting a full Senate floor vote before the August 2026 recess, with negotiators working to finalize compromise text in the weeks following the July 4 holiday. Lawmakers have roughly 20 working days after July 13 to advance the bill before Congress breaks.

The CLARITY Act cleared the Senate Banking Committee in May 2026 with a 15-9 bipartisan vote and was formally placed on the Senate Legislative Calendar in June, making it eligible for a full floor vote. But the road ahead is still far from clear. The bill must reconcile differences with the Senate Agriculture Committee's version, clear a 60-vote floor threshold, and survive a final conference with the House before reaching the president's desk.

Global Stakes

Lummis has framed the stakes in stark terms. Without action, she argues, other countries will step in to fill the regulatory vacuum and set international digital asset standards without American input. The European Union's Markets in Crypto-Assets (MiCA) framework is already in force, and jurisdictions such as Singapore have been courting digital asset firms for years.

The CLARITY Act itself draws clear jurisdictional lines: the CFTC would take exclusive authority over digital commodity spot markets, while the SEC would retain oversight of investment contract assets. That distinction matters enormously for crypto firms, shaping listing decisions, disclosure obligations, custody standards, and the prospects for broader institutional adoption.

The bill also builds on momentum from the GENIUS Act, the stablecoin legislation signed into law in July 2025, which Senate Banking Committee Chairman Tim Scott has described as a foundation that Congress must now build upon with broader market structure rules.

Remaining hurdles include unresolved questions around AML requirements, ethics guardrails for elected officials with ties to the crypto industry, and how stablecoin treatment will be handled across committee jurisdictions. Whether negotiators can resolve those issues before the August recess will determine whether the US takes the lead on global crypto standards, or spends the next several years playing catch-up.
