Senate Banking Committee Advances Landmark Crypto Bill

Senator Cynthia Lummis (@SenLummis) has confirmed the successful committee markup of the Digital Asset Market Clarity Act, a milestone that crypto advocates have been pushing toward for over a year. "This markup brings us one step closer to cementing America's place as the global leader in financial innovation," she said, framing the moment as pivotal for the future of digital assets including $BTC and $ETH within the US financial system.

The legislation, formally known as H.R. 3633, cleared the House on July 17, 2025, by a 294 to 134 bipartisan vote. Since then, it had stalled in the Senate through two cancelled markup sessions and protracted negotiations over stablecoin regulation. The Senate Banking Committee's May 14 session marked the bill's first formal committee vote on the Senate side, with proceedings held at the Dirksen Senate Office Building in Washington, D.C.

High Stakes, Tight Deadlines

The timing matters significantly. Senators Lummis and Bernie Moreno have both warned that failure to clear the Senate Banking Committee before the Memorial Day recess could push the next viable legislative window to 2030 or beyond. The White House, meanwhile, has set July 4 as its target date for a presidential signature.

The bill aims to draw a clear line between digital assets regulated as securities by the SEC and those treated as commodities under CFTC oversight, while setting operational standards for exchanges, custodians, and DeFi participants. SEC Chair Paul Atkins has publicly urged Congress to advance the bill, stating both the SEC and CFTC are ready to implement the framework once signed into law.

Not everyone is on board. Democrats have threatened to withhold support unless the bill includes ethics provisions targeting crypto holdings by public officials, a demand Republicans argue could derail the process. Coinbase's head of US policy has noted the bill will need at least 60 votes and meaningful bipartisan cooperation to pass the full Senate.

A successful Senate passage would send the bill to reconciliation with the House version, potentially delivering the most comprehensive digital asset regulatory framework in US history.
